Kyle D. Giacco

Mr. Giacco joined the firm in 1997 and has been a Partner since 1999. He has achieved Martindale-Hubbell’s highest rating for legal ability and ethical standards based on both judicial and peer review. Mr. Giacco has trial experience in both Federal and State Courts in Texas. He has also successfully handled appeals in State Court and at the U.S. Fifth Circuit Court of Appeals, including Tubacex v. M/V Risan, 45 F.3rd 951 (5th Cir. 1995); Lyons v. State Farm Lloyds and Nat. Cas. Co., 41 S.W.3d 201 (Tex. App. Houston. [14th Dist.] 2001, pet. denied); Saudi v. Brieven, 176 SW3d 108 (Tex. App-Houston [1st Dist] 2004 pet. denied); Flutobo, Inc. v. Holloway, 419 S.W.3d 622 (Tex.App.–Houston [14th Dist.] 2013, pet. denied.); In re C.R. England, Inc., 413 S.W.3d 838 (Tex.App. Beaumont 2013, orig. proceeding); and most recently MEMC Pasadena, Inc. v. Riddle Power, LLC, 14 13 00117 CV (Tex.App.–Houston [14th Dist.] August 4, 2015, no pet.).

Before joining the firm, Mr. Giacco practiced in the areas of maritime and oil field personal injury, maritime cargo, insurance subrogation, oil pollution litigation and insurance coverage matters. At Daw & Ray, his areas of concentration include personal injury, property damage, insurance coverage analysis and litigation, insurance bad faith and extra contractual litigation, construction litigation, contractual indemnity litigation, premises liability, insurance subrogation and appellate work.

Mr. Giacco received his Bachelor of Arts in Political Science and History from Rice University in 1988 and his Doctor of Jurisprudence, with honors, from the University of Texas School of Law in 1991. In that same year, Mr. Giacco received his license to practice in the State of Texas. He is admitted to all Federal District Courts in Texas the Eastern District of Wisconsin and the Fifth Circuit Court of Appeals. In 1993, Mr. Giacco co-authored “Admiralty and Maritime Law: The Pitch, Roll and Yaw of the U.S.(S) Supreme Court,” 28 Tort & Insur.L.J. 137 (1993).
